Terms and Conditions of Entry for the Festive Season Classic 2024 Survey Promotion
The Promoter of this promotion is Prezzee Inc. of 368 9th Avenue, 12th Floor, New York, NY 10001 (the Promoter).
The promotion is subject to the following terms and conditions:
1. By participating in the promotion, entrants accept and agree to be bound by these Terms and Conditions.
2. Entries must comply with these terms and conditions to be valid.
The Promotion
3. The promotion will commence at 1 AM EDT on 11 September 2024 and finish at 1 AM EDT on 25 September 2024 (Promotion Period).
4. The promotion has three (3) prizes, being 3 x $50 Prezzee Smart eGift Cards issued by the Promoter (Prizes). Use of the Prizes are governed by the Promoter’s Terms of Service.
5. The Prizes are not transferable or redeemable for cash. The total prize pool value is $150.
6. Any and all prize related expenses, including without limitation any and all federal, state and/or local taxes shall be the sole responsibility of the Winners.
7. The promotion is open to US residents over the age of 18 years who have a valid email address and have completed the Festive Season Classic 2024 Survey in full during the Promotion Period.
How to Enter
8. To enter, entrants must:
a) receive an invitation from the Promoter to participate in the Festive Season Classic 2024 Customer Survey (Survey);
b) click on the online survey link contained in the email, or follow the pop-up on the Prezzee website; and
c) complete the Survey by answering the Survey questions, completing the entry form and submitting the completed Survey.
9. Entry into the promotion is free.
10. All entrants must opt in to receive email promotions/marketing material from the Promoter. By entering the promotion, entrants agree to subscribe to the Promoters marketing emails.
11. For each Survey completed, eligible entrants will receive one (1) entry into the promotion.
12. All submitted Surveys and entries become the property of the Promoter. By submitting an entry to the Promoter, you warrant you are the owner of the intellectual property rights in the content, and you voluntarily waive all moral rights that you may have in such content or entry.
How Winners are Determined
13. The promotion is a game of chance.
14. At 1 AM EDT on 25 September 2024, each valid entry will be entered into a process of random selection. Three (3) winning entries will be selected at a random draw (Winners). The random draw will take place at Level 3, 9 Castlereagh Street, Sydney NSW 2000 Australia.
15. The odds of winning depend on the number of eligible entries received.
16. The Winners’ names can be obtained by sending an email to research@prezzee.com within thirty (30) days after the closing date of the prize draw.
17. The Promoter’s selection of the Winners will be final and binding. No correspondence with entrants or any other person will be entered into.
Claiming the Prize
18. The Winners will be notified by email within seven (7) business days of the draw.
19. The Prize will be emailed to the Winners’ email address that is held on record by the Promoter at the time of prize draw within seven (7) business days of the draw date.
20. If the Winners do not claim the Prize within three (3) months from the date of the prize draw, the entry will be deemed invalid and the Promoter will conduct a redraw at Level 3, 9 Castlereagh Street, Sydney NSW 2000 Australia at 1 AM EDT on 23 December 2024.
21. It is the responsibility of each entrant to notify the Promoter of any change in their contact details.
22. The Promoter shall have no liability for a Winners failure to receive notices due to spam, junk-email or other security settings, for a Winners provision of incorrect or otherwise non-functioning contact information.
23. The Promoter is not responsible for any problems or technical malfunctions of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any website, or any combination thereof, or any other technical failures, including but not limited to any injury or damage to participants or any other person’s computer related to or resulting from participation in or downloading any materials in this promotion.
Other Terms
24. If the Prizes are unavailable for reasons beyond the Promoter’s control, the Promoter reserves the right to substitute the Prizes with prizes of equal or greater monetary value. This right is subject to any applicable legislation, regulations or directions from a regulatory authority.
25. The Winners use of the Prizes is entirely at their own risk. The Winners release and indemnify the Promoter from and against any liability arising from the Winners acceptance and use of the Prizes and the Winners participation in the promotion.
26. To the extent permitted by law, the Promoter and its related entities and their respective directors, officers, employees and agents will not be liable for any personal injury, loss or damage, whatsoever which is suffered or sustained (including, but not limited to) indirect or consequential, financial or other loss) to or by an entrant or Winners.
27. This promotion cannot be used in conjunction with any other offer.
28. The eligibility of entries is solely within the discretion of the Promoter.
29. The Promoter accepts no responsibility for late, lost, misdirected or damaged entries or other communications.
30. If for any reason this promotion is not capable of running as planned, the Promoter reserves the right to vary the terms of, or cancel, terminate, modify or suspend the promotion at any time without liability to any entrant or other person.
31. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules.
32. These Terms and Conditions are subject to change. For more information on how we use data, please see our Privacy Policy. By participating in the promotion, entrants hereby agree to Promotor’s collection and usage of their personal information and acknowledge that they have read and accepted Promoter's Privacy Policy. Further, entrants agree that all information collected through the Survey will be used for market research.
33. The Promoter reserves the right, at any time, to request verification of the age, identity, residential address or any other information relevant to participation in the promotion of all entrants. The Promoter reserves the right to disqualify any entrant who provides false information or fails to provide information that is reasonably requested by the Promoter.
34. The Promoter reserves the right, in its sole discretion, to refuse to accept entries which are incomplete, indecipherable, offensive, do not comply with these Terms and Conditions, or which contravene any applicable laws or regulations.
35. The Promoter reserves the right, in its sole discretion, to disqualify any entrant who has breached any of these Terms and Conditions, has engaged in unlawful or improper conduct, or otherwise acts to cheat or undermine the fairness of the promotion by, for example, tampering with, or using or exploiting errors in, the entry process to obtain a competitive advantage over other entrants.
36. Directors, employees and contractors (and their immediate families) of the Promoter, its related companies or its agencies, are not eligible to enter this Promotion. Immediate family means spouse, ex-spouse, child, step-child, parent, step-parent, legal guardian, sibling or step-sibling.
37. These Terms and Conditions shall be governed by the laws of New York and any dispute shall be subject to the exclusive jurisdiction of New York courts.
